This article identifies five of the major potential legal risks related to the use of artificial intelligence (AI) in the hiring process. The first is that AI could lead to a bias in job candidates; without being properly monitored, it could lead to rejection of high-quality candidates due to their gender, race, age, or other characteristics. Second, firms may face liability issues if job applicants experience technical issues while using AI. Third, AI could be vulnerable to cyberattacks, potentially leading to damaging results. Fourth, firms that use AI in the hiring process must remain compliant with applicable data protection regulations. Finally, companies that use AI in hiring must take reasonable measures to protect confidential employer data.
